How To Appeal An SCC Decision


Any suspension from the SCC can be appealed. Follow the process below in order appeal an SCC suspension decision to the Executive Appeals Committee.

If you’ve been issued a suspension from the Sportsmanship and Conduct Committee (SCC), you may appeal it by following the steps below.
 
1. Contact the SCC to indicate your intent to appeal your suspension within 24 hours of receiving your suspension notice.
2. You must then post a $100 fee to appeal a suspension which will be returned to you if your appeal is successful. This can be paid by providing a cheque made payable to “Calgary Minor Basketball Association” prior to your appeal hearing starting (can be given at the hearing if in person).
3. The CMBA Staff member of the SCC will then convene the Executive Appeals Committee from the CMBA Executive. This will be made up of 3 executive members who will vote on the appeal, and one SCC member who does not have a vote. All members will be cleared of potential conflicts of interest.
4. The Executive Appeal Committee will make every effort to schedule a prompt online (Zoom, Google Meet, etc) or in person hearing with you based on the availability of all involved.
5. You may bring someone (one person) to the hearing for support, or to represent you but the committee must be made aware of this prior to the hearing. Anything they say or do in the meeting will be considered as a representation of you.
6. If you have any witnesses or other people whose testimony is relevant, please bring their written or typed statements, with contact information (full name, phone, email), and what their relationship to you/the situation is.
7. In this hearing you will be expected to share new/additional information about the situation. If no new information is provided beyond what the SCC originally received, the decision will likely be upheld.
8. The Executive Appeal Committee will deliberate after you’ve finished sharing the information.
9. The Executive Appeal Committee has the power to uphold, reduce, rescind, or increase a suspension and their decision is final.
10. The decision will be based on majority vote.
11. You will be contacted in writing within 24 hours of your appeal hearing with the committee’s decision.
